The financial market is governed by laws and ordinances.
SFMA's statutory powers to supervise banks, insurances, financial market infrastructures, financial institutions and collective capital investment schemes are derived from the legal basis set out in the Financial Market Supervision Act, financial market laws and implementing ordinances.
SFMA takes actions based on the legal provisions set out in financial market law. The regulations defined in the Financial Market Supervision Act lay the legal foundations upon which SFMA was established. The following acts also govern financial market regulation:
- Banking Act for banks
- Insurance Supervision Act and Insurance Contract Act for insurances
- Financial Services Act for financial services providers and client advisors
- Financial Market Infrastructure Act for financial market infrastructures
- Financial Institutions Act for financial institutions
- Supervisory Organisations Ordinance for supervisory organisations
- Collective Investment Schemes Act for funds
- Anti-Money Laundering Act for all financial market participants
- Mortgage Bond Act for mortgage bonds.
Statutory provisions are also detailed in ordinances issued by the Federal Council and SFMA ordinances.
